Assessment of legal capacity and its Implementation Process

On June 6, 2016, presentation of the assessment report on legal capacity and its implementation process was held in the office of the Open Society Georgia Foundation. The report has been prepared by Open Society Georgia Foundation and Human Rights Education and Monitoring Center (EMC).

In 2014, the Constitutional Court declared unconstitutional the legislative provisions on the basis of which the legal capacity has been developed, following which the Parliament of Georgia amended the legal capacity.

The report aims at evaluating the new system in the light of the standards and constitutional decision defined under the Convention of the Rights of Persons with Disabilities, highlighting its key characteristics, approaches, legal gaps and difficulties related to implementation. The document also includes recommendations for the state institutions.

The presentation was attended by the parents of children with disabilities, and representatives of the Parliament, Samkharauli National Expertise Bureau, Ministry of Labour, Health and Social Affairs of Georgia, international organizations and non-governmental organizations.
