NGOs respond to President’s Decrees as of October 5

On 5 October 2012 the President of Georgia issued two decrees (#924 and #925), under which the control over the Legal Entity of Public Law State Procurement Agency and Legal Entity of Public Law Special Communications and Information Agency was assigned to the Special State Protection Service of Georgia.

The Special State Protection Service of Georgia is directly subordinated to the President of Georgia.  Therefore, assigning control of the above agencies to this service will further increase the President’s influence over these bodies.

In accordance with Georgian law on the Special State Protection Service of Georgia, the latter is tasked with the protection of the president, high-ranking officials of the legislative, executive and judicial authorities of the country, as well as high-ranking foreign visitors, representatives of international organizations and other important persons.

Therefore, control of the State Procurement Agency and Special Communications and Information Agency does not match with the duties of the Special State Protection Service of Georgia defined by the law.

Moreover, in our opinion, it is not justified to make such a decision in the post election period before the launch of operation by new Parliament and the government, consequently additional explanations should be provided for the public.
